Hemp Ban 2026: What to Buy Before December 11, and What Stays Legal

Federal law now caps finished hemp products at 0.4 mg of total THC per container, and counts THCA and delta 8 toward that total. Most of the change takes effect on December 11, 2026. In practice that ends hemp delta 9 gummies, THCA flower and THC drinks as federally lawful products, while THC-free CBD stays legal.

Below: what is affected and when, what it means if you live in a legal state, what is worth buying before the deadline, and the THC-free options that will still be on sale in December. For the legal detail and the latest dates, see our federal hemp deadline tracker.

The Short Answer

Hemp THC products you can order online today, such as delta 9 gummies, THCA flower and pre-rolls, delta 8 and THC seltzers, almost all exceed 0.4 mg of THC per container, so they lose hemp status under federal law. Products made with cannabinoids the plant cannot produce naturally, such as THC-O, lose it on November 12. Most of the rest, including the per-container cap and the shift to counting THCA, follows on December 11. Converted delta 8 is contested: several law firms and at least one state regulator read it as losing status on November 12, so plan for the earlier date.

THC-free CBD (isolate and broad spectrum) is designed to contain no THC and is not the target. Full-spectrum CBD with trace THC is at risk, because a whole bottle often adds up to more than 0.4 mg.

What Is Affected, and When

Our summary of how the federal change applies to common products. State laws can be stricter and some set earlier dates.

Product Typical THC Federal status Date
Delta 9 THC gummies (hemp) 5 to 10 mg per gummy Over 0.4 mg per container: loses hemp status December 11, 2026
THCA flower and pre-rolls THCA counts as total THC Loses hemp status December 11, 2026
THC seltzers and drinks 2 to 10 mg per can Loses hemp status December 11, 2026
Delta 8 (converted from CBD) Varies Contested; plan for the earlier date November 12 or December 11, 2026
THC-O and other cannabinoids the plant cannot make Varies Loses hemp status November 12, 2026
Full-spectrum CBD oils and gummies Trace THC, often over 0.4 mg per bottle At risk, depending on the product December 11, 2026
THC-free CBD (isolate, broad spectrum) None detectable Designed to comply Not affected

Illinois, New Jersey (for drinks) and Virginia set November dates under their own state laws, which a federal delay does not change. Check your state before you order.

What to Buy Before December 11

If there is a hemp THC product you use regularly, these are the ones we would stock up on now, at the prices running this week. Buy only what you will use: gummies keep for months, but potency fades, and our THC gummies shelf-life guide explains how to store them.

Hemp Ban FAQ

When does the hemp ban take effect?

Most of it on December 11, 2026, after a delay signed in September. Products made with cannabinoids the plant cannot naturally produce, such as THC-O, lose hemp status on November 12, and converted delta 8 may too. Our tracker follows the details.

Will the hemp ban affect legal states?

It does not change state-licensed marijuana programs. It ends hemp THC products sold under the federal hemp definition, including those shipped to states without legal marijuana.

Will the hemp ban affect dispensaries?

Licensed dispensaries in legal states sell marijuana under state law, which the hemp change does not touch. Some states are removing over-limit hemp products from licensed shops.

Is CBD banned?

No. THC-free CBD is designed to comply. Full-spectrum CBD with trace THC may exceed 0.4 mg per container, so check the lab report.

Can THC still be shipped to all 50 states?

Hemp THC products over the new limit lose federal hemp status, so shipping them across state lines loses that federal cover. Many states already restrict them.
