Is THCA and Delta-8 Legal in Wisconsin? (2026)

By any measure we can find, Wisconsin is the least regulated hemp market in the United States. There is no potency limit, no product registration, no retail licence, and no statewide minimum age.

The delta-9-only standard

Wisconsin follows the 2018 Farm Bill definition exactly: hemp is capped at 0.3% delta-9 THC on a dry weight basis. No total-THC formula, no THCA multiplier, no exclusion for converted cannabinoids.

THCA flower passes. Delta-8, delta-10 and THCP pass. High-milligram gummies pass. All of it is sold openly in gas stations, liquor stores, supermarkets and online.

No age limit, except in two cities

Wisconsin has no statewide minimum age for buying hemp THC products. The only age restrictions in the state are local:

  • Milwaukee (2025) bars sales to under-21s.
  • Madison (2025) does the same, and additionally restricts retailers within a quarter mile of youth-serving organisations.

Outside those two cities, state law does not set an age. Many retailers apply 21+ as policy.

SB 644 / AB 680, which would have created a statewide 21+ floor plus testing requirements, failed to pass on 23 March 2026.

The one thing Wisconsin does regulate: vapes

A narrow exception, and a recent one. Under 2023 Wisconsin Act 73, hemp electronic vaping devices must be listed on the Department of Revenue's Electronic Vaping Device Directory, and retailers need municipal licences.

Nicotine devices came under the requirement on 1 September 2025. Hemp-containing, nicotine-free vapes followed on 1 July 2026. Penalties run to $1,000 per day per device plus seizure for unlisted products.

So Wisconsin regulates the device but not the cannabinoid inside it.

Four bills, all dead

The 2025–26 session produced several serious attempts and none survived:

  • AB 503 — total-THC definition
  • AB 606 / SB 681 — an alcohol-style Department of Revenue framework with 21+, potency caps, testing and registration
  • SB 644 / AB 680 — 21+ and testing
  • AB 747

All died when the session ended in March 2026.

What this means for buyers

Everything is on you. No state agency verifies potency, checks labels, licenses sellers or requires lab testing of consumable hemp products in Wisconsin.

November changes this

Wisconsin's permissiveness runs on the old federal definition, and that definition is what changes. When the narrowed standard takes effect in November or December 2026 — 0.3% total THC including THCA, 0.4 mg per container — Wisconsin's market is constrained by federal law regardless of what Madison does or does not pass.
