The Federal Rules Are Changing, and This Page's Categories Are the Ones Affected
Everything above describes products as they are sold today. A change in federal law is due before the end of the year, and gummies, drinks and THCA flower are precisely the categories it reaches. If you are buying any of them, read this part before you order.
What Section 781 does
Section 781 of Public Law 119-37 rewrote the federal definition of hemp. Two parts of it matter here. The THC test changed from delta-9 THC only to total THC. And finished products picked up a limit of 0.4 mg combined total per container, covering total THC plus other cannabinoids the FDA is required to list as having similar effects, a list the FDA has never published.
The word "container" is statutory, not our paraphrase. It is defined as the innermost wrapping, packaging or vessel in direct contact with a final hemp-derived cannabinoid product. A single seltzer can is a container. So is a gummy jar. That is what makes the figure so small in practice, and it is why this is not a high-dose rule. As Jonathan Miller, general counsel of the U.S. Hemp Roundtable, put it to Harvest Public Media: "Even the vast majority of non-intoxicating CBD products have more than 0.4 milligrams of THC per container."
The arithmetic, on figures printed this week
Take the Vena seltzers in the table above, where the strength is printed on the collection page and a can is unambiguously a container. The following multiples are our own arithmetic against the 0.4 mg figure:

The 2 mg can is the lowest-strength seltzer printed on that collection page, and it is still five times the figure. That is the clearest way we know to show that 0.4 mg per container is not a limit only strong products exceed.
When: we read it as 11 December 2026, and that is a minority reading
Section 2019 of Public Law 119-103 delayed most of Section 781. We read the delayed provisions as taking effect on 11 December 2026, which is 51 days from 21 October 2026 on our own count. Several of the law firms we have read put the operative date at 12 November 2026 instead, which would be 22 days. Ours is the minority reading among them. The prudent thing for a shopper is to plan for 12 November and treat 11 December as upside. State law can bite earlier regardless. Illinois has published that its Industrial Hemp Act is repealed on 12 November 2026. Our state-by-state guide tracks where that leaves shipping.
A partner brand is already reformulating, and its number is not the statute's number
This is worth knowing before you buy a December supply of anything. Medterra, one of the three brands in the table above, has carried a page since 3 September 2026 titled "What the New Federal Hemp Rules Mean for Your Medterra Subscription". It tells customers, in its own words, that "Starting December 11, 2026, hemp products sold in the U.S. are expected to fall under a new, lower THC threshold" and that "The current federal timeline points to December 11, 2026."
It also tells subscribers what will happen to their orders: "If you're subscribed to our 5mg gummies: your subscription will automatically move to our new 2.5mg formula", and "Your subscription will automatically update to our new 2.5mg version starting with your first December shipment." Asked directly whether it is shutting down or discontinuing products, the page answers: "No. We're adjusting formulations to stay compliant with the new federal threshold."
An open question we are not going to resolve for you
The threshold figure Medterra's page gives is, in the fragment we were able to transcribe, "around 3mg of total THC per serving", hedged on the page as currently anticipated. That is a figure per serving. The figure in Section 781 is per container. The words "per container" and the number 0.4 do not appear anywhere on that page.
We are not treating one as a correction of the other, because they are different units and we have not seen them reconciled. But the difference matters to a shopper. If the per-container figure is the operative one, halving a per-serving dose does not by itself bring a multi-count jar under it: at the 20-count size we recorded for that product in September, 2.5 mg a gummy is 50 mg in the jar, which is 125 times the 0.4 mg figure on our arithmetic. We did not read a pack count on Medterra's gummy pages on 21 October, so treat that multiple as conditional on the September count rather than as a current measurement.
What we would do: read the batch certificate and the container total, not the per-serving number, on anything you are buying to last past the deadline. Our guide to reading a COA explains where to find both.
Three partner storefronts, three different postures, same day
We read all three on 21 October 2026. What they print, scoped to those documents:
Selling the deadline
Its THC seltzer collection carried "Stock up before new regulations in December" at the top of the page, on the same document as an FAQ line reading "it's all thanks to the 2018 Farm Bill."
Naming the ban in the sale
Its THCA flower collection carried "BAN Blowout Sale Up to 50% OFF". The same page says "Koi's cannabinoid products are legal under the 2018 Farm Bill" and describes the federal test as "less than 0.3 percent Delta 9 THC by dry weight". It also notes that "some states use the 'total THC' standard, which counts THCA and THC together, making most THCA flower illegal" - which is the test Section 781 moves to federally, and the one that bears directly on a smokable THCA product.
Quiet on the shelf, explicit in the blog
Its THC gummies collection printed no deadline language at all on 21 October. The only November date on it was a sweepstakes line, "NO PURCHASE NECESSARY. Ends 11/30/26." The reformulation page quoted above is where it addresses the change instead.

What the FDA has not done
FDA has issued no 2026 Federal Register rulemaking directed at cannabinoids. The lists of cannabinoids it was required to publish within 90 days of Public Law 119-37, which were due on 10 February 2026, are 253 days late as of 21 October 2026 on our own count. The restrictions take effect regardless; the missing lists determine only how far past total THC the exclusions reach.
