The 2023 FDA warning letter

On 18 July 2023 the FDA wrote to Koi about these specific products. The agency’s position was that Koi’s Delta 8 Gummies were adulterated under section 402(a)(2)(C)(i) of the Food, Drug and Cosmetic Act, because delta-8 THC is not an approved food additive and there is no established basis for treating it as generally recognised as safe in conventional food.

On formulation and price these are good gummies, and the Extra Strength jar in particular is the better buy by a clear margin — the same 1500mg of delta-8 for $20 less, across five flavours instead of three.

The problem is everything around the product. Twenty-six states cannot receive them, the FDA has an open position on delta-8 in food, and stock has moved around a good deal through 2026.
