Is THCA and Delta-8 Legal in Georgia? (2026)

Georgia took an unusual route. Most states that removed hemp flower from shelves did it with a total-THC formula. Georgia just banned the flower.

Flower is banned by form, not by potency

Georgia Department of Agriculture Rule 40-32-5-.01 prohibits the retail sale of "the flower or leaves of the Cannabis sativa L. plant, regardless of the total delta-9-THC concentration."

That last clause is the whole point. It does not matter whether the flower would pass a delta-9 test, a total-THC test, or any other test. Retail sale of hemp flower is unlawful in Georgia as a category. The GDA's retail licensing page repeats it.

This makes Georgia cleaner than most states on the THCA question — there is no argument to have, because the ban does not turn on chemistry.

Delta-8 is legal

Delta-8, delta-10, THC-O acetate and other isomers appear by name in Georgia's mandatory certificate-of-analysis and labelling rules. They are regulated products, not prohibited ones — a meaningful distinction, and one that puts Georgia among the more permissive states on converted cannabinoids.

The milligram limits

Hemp may not be added to conventional food, and hemp products may not contain alcohol.

A 10 mg per-piece cap is a sensible middle position — it matches the standard serving in regulated cannabis markets and excludes the 50 mg and 125 mg tiers described in our potency arms race piece.

Age and licensing

21+, under SB 494, with a warning-sign requirement effective 1 October 2024.

Retailers need a GDA consumable hemp licence at $250 per location per year, one location per licence. New retailers may not open within 500 feet of a K-12 school, effective 1 July 2024.

SB 33 is signed but not yet clear

Governor Kemp signed SB 33 on 11 May 2026 as Act 461, amending the Georgia Hemp Farming Act to limit the total THC concentration of consumable hemp products and revise the certificate-of-analysis provisions. It passed the Senate 50–6, the House 151–14, and cleared final agreement votes in early April 2026.

We have to be straight about the limits of what we can tell you here. We could not retrieve the enrolled text of Act 461 from any available source. Contemporaneous reporting published before final passage described it as banning cannabinoids that the plant cannot naturally produce — HHC, for example — with 2027 implementation, while leaving delta-8 legal. An earlier tracked version would have imposed a 0.4 mg per container cap.

The milligram limits in the table above are the currently published GDA rules. Treat SB 33's operative caps as unconfirmed until the GDA publishes amended rules, and check the GDA directly before relying on any specific number.
